Taking A Look At Public Liability Insurance

Taking a look at public liability insurance should be a recommended activity for any business when it comes to its operations and the people that interact with it. Specifically, this kind of insurance is part of the broader liability insurance category, and whether a business has it or not will depend on several different factors, generally speaking.

Basically, this specific type of liability insurance is constituted to ensure that a business is protected whenever something it does or something that occurs on its premises creates a negative effect such as an injury to a third party. Specifically, “third party” means customers, visitors to the business, guests or even trespassers who are hurt while at the business.

It might seem to be illogical for a business to carry insurance to protect it in case a trespasser becomes injured while on the property, but tort law (a tort is a civil wrong) distinguishes between a possibly-criminal acts such as trespass and the injury that occurs to a person engaged in the trespassing. That’s why it can be a good idea for a business to carry this kind of insurance, by the way.

Nowadays, many states make it mandatory that a business carry some form of this liability insurance, depending on the kind of organization or form it takes (corporation or sole proprietorship, for example) and its size. Some states, however, don’t mandate it though a business should carefully consider what its costs of defending against a liability lawsuit would be versus carrying the insurance instead.

Smart business people should always consider whether or not they should add this form of insurance to the insurance portfolio carried by their business. They should always have a risk assessment conducted to examine inherent risk of injury while a third party is on the premises, as well. Usually, busy facilities such as shopping malls or banks and the like normally carry such insurance as a matter of course.

Public liability insurance should be looked at as a means of immunizing or protecting a business against liability lawsuits due to injury that may happen to third party guests, visitors or even trespassers. Businesses should also take the time to examine carefully any proposal or binder being recommended in order to compare costs versus benefits before making the decision to purchase.
